The order of enactment of this Law

The procedure for enactment of this Law, see Article 21
      This Law regulates public relations arising as a result of the realization of the constitutional right of everyone to freely receive and disseminate information by any means not prohibited by law.
Article 1. Basic concepts used in this Law
      The following basic concepts are used in this Law:
      1) information - information about persons, objects, facts, events, phenomena and processes received or created by the owner of information recorded on any medium and having details that allow it to be identified;
      2) access to information - guaranteed by the state, enshrined in the Constitution and laws of the Republic of Kazakhstan, the right of everyone to freely receive and disseminate information in any way not prohibited by law;
      3) information user - an individual or a legal entity requesting and (or) using information;
      4) the Internet portal of open budgets is a component of the e-government web portal, which provides budget reporting, consolidated financial statements, state audit and financial control results, as well as public discussion of draft budget programs and reports on the implementation of budget programs;
      5) open data - public electronic information resources, presented in a machine-readable form and intended for further use, re-publication in an unchanged form;
      6) the open data portal - a component of the e-government web portal, which provides centralized storage of descriptive and reference information on open data;
      7) the Internet portal of open regulatory legal acts is a component of the "e-government" web portal, which provides for the placement of draft concepts of draft laws and normative legal acts;
      8) information with limited access - information classified as state secrets, personal, family, medical, banking, commercial and other secrets protected by law, as well as service information marked "For official use";
      9) the blog platform of the first heads of state bodies - a component of the e-government web portal, which provides the opportunity for citizens to send requests and receive answers to them from the first leaders of state bodies;
      10) a unified platform of Internet resources of state bodies - a technological platform designed to accommodate Internet resources of state bodies;
      11) an online portal for assessing the effectiveness of government agencies - a component of the e-government web portal, providing information on the assessment of government agencies, reports on the achievement of target indicators of strategic plans and development programs of territories, as well as public discussion of the activities of government agencies;
      12) request - a request in oral or written form, including in the form of an electronic document, on the provision of information, sounded or sent to the information owner in the manner prescribed by this Law.
Article 2. Legislation of the Republic of Kazakhstan on access to information
      1. Legislation of the Republic of Kazakhstan on access to information is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other normative legal acts of the Republic of Kazakhstan.
      2. If an international treaty ratified by the Republic of Kazakhstan establishes other rules than those provided for in this Law, the rules of the international treaty shall apply.
Article 3. Scope of application of this Law
      1. This Law acts on the territory of the Republic of Kazakhstan and extends to public relations related to access to information not related to information with limited access.
      2. The effect of this Law does not apply to appeals of individuals and legal entities, the procedure for consideration of which is established by the legislation of the Republic of Kazakhstan on administrative violations, criminal procedural, civil procedural legislation of the Republic of Kazakhstan.
      3. The validity of this Law does not apply to the order of consideration of requests established by the Law of the Republic of Kazakhstan on the National Archival Fund and Archives.
      4. The effect of this Law does not apply to the procedure for providing information to the mass media provided for by the Law of the Republic of Kazakhstan "On Mass Media."
Article 4. Basic principles of access to information
      Ensuring access to information is based on the following principles:
      1) legality;
      2) openness and transparency of information holders;
      3) reliability and completeness;
      4) relevance and timeliness;
      5) equal access to information;
